Sales Tax on Services

History of Sales Tax on Services

There is a long history in Florida of failed efforts to tax services through our Constitution. While many members of the business community have fought against a services tax since 1987, the Coalition to Protect Florida s Economy is a unique group of organizations who have waged three consecutive successful legal challenges since 2001 against efforts to place a services tax in Florida s Constitution.

In 2002, a legislatively-proposed Constitutional amendment that would have created a services tax was removed from the ballot by the courts because it was not clear to voters that voting yes on the amendment would create a services tax. In 2004, a similar Constitutional amendment was also removed from the ballot by the courts on similar grounds. Finally, for the 2006 ballot, two separate proposed Constitutional amendments that would have turned Florida s tax structure on its head and created a services tax were removed from the ballot by the courts due to shortcomings in ballot language.
