Amendment 4 would affect our state's economy and quality of life by requiring every local government comprehensive plan change to be approved by voters. It would result in an average of 200 - 300 plan changes to be approved every year, greatly increasing the cost of local government, place unreasonable and expensive burdens on business and property owners, and limit the ability of our communities to adapt to the challenges of the 21st century.

AIA Florida is opposed to the Hometown Democracy Constitutional Amendment that would require all rezoning and amendments to local comprehensive plans to be approved via referendum. (AIA Florida Legislative Policies approved in January 2007)
* Rezoning issues:
"Most agree with The Post that this almost certainly includes every aspect of a community's comprehensive plan, right down to traffic signalization issues and minor technical changes. Many would say the amendment could even be extended more broadly to include common zoning issues as well — a claim likely to be debated in court, at taxpayer expense, if the amendment passes." - The Palm Beach Post Letter to the Editor - by Brian Seymour. Mr. Seymour is a land-use lawyer.
"Amendment 4 is vague and confusing, but one thing is clear: Its language is extremely broad. The scope of this amendment exceeds any current requirements for comprehensive plans in Florida and could easily apply to zoning approvals unrelated to comprehensive plan amendments. Under Amendment 4, at a minimum, we will be asked to vote on every change to a local comprehensive plan. At worst, Floridians will be voting on garden variety zoning changes, too." - The Miami Herald Letter to the Editor - by Jeffrey Bercow. Mr. Bercow is a shareholder of Bercow Radell & Fernandez, P.A. and has practiced land use and zoning law for over 25 years.
